ASSUMPTION OF THE RISK & WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19 * In accordance with the most recent guidance and protocols issued by the World Health Association (WHO) and the Centers for Disease Control and Prevention (CDC), the undersigned hereby agrees, represents, and warrants that the undersigned shall not visit or utilize facilities, services, programs of Pilatez.ca (other than exclusively online) within 14 days after (i) returning from outside of Ontario; (ii) exposure to any person returning from outside of Ontario, or (iii) exposure to any person who has a suspected or confirmed case of COVID-19. The undersigned hereby agrees, represents, and warrants that the undersigned shall not utilize the facilities, services, and programs of Pilatez.ca if he or she (i) experiences symptoms of COVID-19, (ii) has a suspected or diagnosed/confirmed case of COVID-19 Pilatez.ca has implemented the recommended protocols and preventative measures recommended by the Government of Ontario to help reduce the spread of COVID-19; however, Pilatez.ca cannot guarantee that you will not become infected with COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending Pilatez.ca and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Pilatez.ca may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Pilatez.ca instructors, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at Pilatez.ca or participation Pilatez.ca classes. On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless Pilatez.ca, its instructors, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Pilatez.ca, its instructors, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any program with Pilatez.ca.
